I had a similar experience, i took matter with the consul general, other than making an apology in the written e-mail I dont think he took any steps in improving the Customer Service @ SFO consulate office. I sent them US postal Money order, so i dont think they duped me...it just cost me extra $20.
Babu mentality is still their for any Govt of india employee and no matter what position they are holding, they all behave same, very rude and corrupt minded, always looking for an opportunity to make quick bucks using their position. Though in your case if you would have write the money order or cashier's check in favor of the consul general, Govt of india account, i dont think they have any legal way to encash these check or money orders in favor of them.
I guess the fraud is when folks send them $20 bills, thats very easy way of stealing the money and especially when they send you the PIO card in the same original envelope which you sent. Something suspicious. Write to WAshington DC office and see if they take any action.

Hi all,
Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
I only have a copy of the H1B approval notice.
A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.
My questions are:
1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?
2. Is it ok if a COPY of the H1B approval notice is sent? Consultancy had a verbal agreement with me that I should work for a year with them , but I don't think anything is on paper. Also they said they would only give me my H1B approval notice (original) once I was placed on a project with them.
3. Does the job title have to be the same? Consultancy applied as Programmer Analyst, and the new company needs a Web Programmer/Server Administrator. Would that cause any issues?
4. The new company plans to do premium processing, so if all goes well, can I start working with them as soon as the receipt notice comes in, or do I have to wait till I have the approval notice in hand?
5. Can the consultancy cause any problems for me with respect to my H1B? Is there any way they can find out about this and revoke my H1B?

See, you are a rational human being and know what to ask for...
But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me. Please check with your lawyer but as per my understanding, your wife needs to be in 'status' to be added as a dependent on the 485. She doesn't have to get on an H4 to be added as a dependent. Since she is on F1, she is already in 'status'.

10/20 is fine with me. Another IV member vs116 has agreed to attend it along with me.

Bush is going back to the Capitol hill next week to push for immigration reform. He is hell bent on signing a CIR bill no matter what and Kennedy and durbin know that this there best chance to give amnesty to illegals and screew us Legals EB so this bill is going to be introduced and will pass for sure

Same excat thing happend to our family. They had to drive down from North Carolina to get the PIO card from Embassy in Washington.

I applied for my daughter's PIO card and sent all the documents as mentioned in the instructions sheet of the embassy website along with the self addressed stamped envelope. I heard from my other friends that even after you send everything in order, the embassy people would call and say that they did not receive the self addressed stamped envelop. It happened to three of my friends. I am the 4th one. They called today to tell that I did not send the envelope.
The funny part that happened with my friends is that, they all sent $20 and the package came in the very envelope they sent in the first place, that the embassy said they didn't receive.
Did anybody of you also had the same kind of experience or similar incident. If so, please do share.
Why are they doing like that? Do they really think we would do like that, trying to save on an self addressed envelope? It really bothered me for the fact that the lady from the consulate was utterly rude when talking. I am amazed how in the world, The Indian Government is still hiring such people? Of more then a billion population, is that the best person the government of India could find for that customer service post? Its a shame and I am ashamed that such dic*heads working and representing India?
Coming back to the issue...she said sternly, send $20.00 or send envelope stamped otherwise the application would not be processed.
Folks, please let me know where I can complain about this careless attitude of this monster woman. What steps can I take to make sure they don't do that again? I live in TN and I can't fly/drive to Washington DC. The questions is not about the money, but the way they are operating without any ethics is deplorable.

Guess what I called again and this time the poor soul knew NOTHING about I-485 rejections!! :p He put me on hold and finally said, "We have received no such notice that they are rejecting I-485s, so if you applied it should be processed".
So much for "educated" call center workers. If this call center was in India, atleast we would all get ONE answer. It may have been the wrong answer, but atleast it would be CONSISTENT :P

I think you guys are current with the Aug bulletin only (EB2 India has been on Apr 04 for a while)...I was asking for folks with BEC EB2 with PDs that have been current for a while but still not received their GCs. WOuld be interesting to know and also gives an indication of how fast really USCIS adjudicates applications once they become current.

In the scenario presented above, or where USCIS erroneously issued a GC when PD is not current, the obligation on the GC applicant's part is to report the error for appropriate resolution by USCIS. Even if the GC applicant (like my best friend who got his GC in 2008) is not aware of the detailed process, and is not tracking RD, PD, ND, the applicant still has an attorney who is representing the applicant. Also, filing the I-485, doesn't automatically guarantee the issuance of a GC (eg of withdrawing $100, expecting to get $100 but getting more than that amount - comparison is not apples to apples when talking about expecting GC after you file I-485).
In the end, when these situations occur it boils down to doing what is ethically and legally appropriate, within an appropriate response time frame.
