If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.


If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

The Administrative Appeals Office (AAO) Processing Times were released on March 2, 2010 with processing dates as of March 1, 2010.

The current processing time for an I-129 H-1B Appeal is 13 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 24 months. Most other cases are within USCIS's processing time goal of 6 months or less.

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Disclaimer: I'm not an immigration attroney, so please check with one for your situations as laws/procedures are changing frequently.

I have a question on filling up this form

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?

There is a slot for I-94 admissions# which I have filled up.

Any help will be appreciated.

Because you already filed I-485 before she turned 21, your daughter is protected by CSPA and she will get her GC as long as your case is approved even if she turned 30 before your AOS is approved (I sincerely hope you are approved before she turns 30 as she must remain unmarried until she gets GC).

By the way, my son is in the same boat as he turned 21 in 2008 too.

I'm working on L1 & have H1 petition without COS.

Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?

Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.

Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?

If not, is there any other option?

Please reply. Help appreciated.

My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.

1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
2) Is it risky to do that? What kinds of problem we may encounter?
3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.

Any advise you can throw will be appreciated.
