a) H1 extension(I797) approved but no I94
b) Visa stamp and I-94 expired when I applied ( my mistake)for extension but I-797 was valid. Have EAD and Advance Paroll
c) Wife is on H4 and I cannot add her to greencard process because priority date is not current.
d) I need to maintain H1 for my wife.
e) She returned to India before her H4 expired.
f) I work at a client location via a middle vendor so recently found out it does not conform to H1 employer-employee relationship.
1) Is there any time restriction on when I should get Visa stamping done?
2) Client agreed to give client letter but I am worried that I will be rejected at H1 visa stamping because of employer employee relationship requirement.
3) Is it a better startegy to not go to India, send my wife for H4 stamping and bring her to US or is it safer for me to go for H1 visa stamping?
4) Should I change jobs to a client who will transfer H1 and continue my greencard (possibly apply for EB2) before going to India for H1 stamping?
5) Please suggest best course of action.

All,
I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

Hi,
Right now NSC shows that the processing dates are "August 10, 2007". What does this mean? Does it mean that
a)All apps with notice dates before Aug 10, 2007 are processed?
b)All apps with receipt dates before Aug 10, 2007 are processed?
c)All apps with notice dates after Aug 10, 2007 are being processed?
d)All apps with receipt dates after Aug 10, 2007 are being processed?
My 485 application has a receipt date of July 19, 2007 and notice date of Sept 18, 2007. Any insight into the dates???

I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

Dear all,
Could you please help with a question? My family has I140 approved and 485 pending. But we are leaving the US. What is the best way to deal with I485?
1. If we withdraw I485, can I apply for B1 visa later to come back for business? Or because we have applied for immigration visa, our B1 application will be denied?
2. If we change I485 to Consular Process, probably we can not apply for B1, right?

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

i just can't buy into the digital lens system.. Lenses are such an investment and I'd hate to go to a system like that, then a few years later have them offer their new "higher end" camera with a full frame.
