This is a public and OPEN forum,
Insulting TheOmbudsman it's just not acceptable, I though we were all H1B educated people who are open to discussion, not just a child crying and insulting as soon as someone contradicts you.
I know many people who stopped comming to this forum (contributing), they just get tired of those insults. If someone has a different opinion, is immediately insulted

I have recently written a paper on this issue in an MBA class assignment. I give most people here credit for enthusiasm and willingness to do something, but they don't seem to grasp the basics about legislative and administrative laws and the hundreds of legal exceptions that take precedence over the EEO legislation.
It's sad the same idea gets recycled and reproduced then goes no where with every disappointing visa bulletin. At least someone should shell out the $200, get the correct legal opinion and let us move on.

Appu, what abt labor cert? Does this advanced degree-holder still have to go thru labor cert? If yes, then the person with advanced degree but no experience has no advantage.
Yeah, that's the tricky part. I think all professions that require advanced
degrees in STEM have been classified (by Section 406) as Schedule A.
Which means you file ETA form 9089 directly to USCIS NOT to the DOL.
That's the "special labor certification" that the Specter mark-up refers to.
The PACE act doesn't have this provision - it excludes future F4 visa graduates from labor certification but says nothing about the current advanced degree holders. Frist's bill seems to exempt all those with advanced degrees and are employed in their field of expertise from going to the DOL for certification. Plus, if you have been employed for 3 years or more, then the quota doesn't apply and you get a visa number right away.

Yes I've called the rebate hot-line (i think it was the main IRS number and reached there by choosing the rebate option)
The agent was very helpful. It was a while back - i had e-filed, but did not check the box for electronic refund (i had to pay) - so it was treated as a paper filing for this case - and got the check on the paper 'schedule'

According to the first guy I talked to, one has already been assigned upon the start of processing of the case.
I just called again and the lady was completely clueless about the whole July 2 fiasco. I will try again in another hour and hopefully I won't get the village idiot again.
For anyone interested in calling themselves here is the info: 1-800-375-5283 options 1, 2, 3 (and possibly 6 after that-I can't remember).

LAR (Last action Rule) will not applicable in this case. It is applicaple only in change of status ( like H1B to H4 or L1B to H1B). Not in H1B to H1B. If you continously maintained H1B status, you are OK, as long as the H1B approval is valid employer2. Employer 1 or Employer 100 can file H1B, even without your knowledge. Therfore, you dont worry. As you were authorized for employer 2 for that period and you worked for them in that period, you are OK. Exlain them in detail with the evidence of H1B approval for employer 2 and pay stubs. Any way, consult an attorney.

If anyone knows the history, this is pretty much happenned to Family based visas. 20 years ago, it was as easy as 1-2-3 and ppl use to get GCs in matter of months or 1-2 years. INS realized this and they started imposing processing dates and delays and what not and as it stands today, it takes about 10 years to get GC on family based.
They may have same plan in mind that instead of paying unemployment to PRs and Citizens, let's kick out the smart ppl who are stealing all the jobs and now their country is taking some of our businesses too.

guys, we got fooled twice with this CIR, I just can't take these rollercoaster drive any more,
WE need to learn lesson from this exercise is that being part of illegals only gives us wrong end of the stick,

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.
