You have probably made up your mind not to attend the rally. Perhaps you think that already many people will attend and that one more or one less person (You) will not make a difference. But it will! In fact, let�s not even think about whether one more or one less person will make a difference. Rather, I invite you to think this way: Do it because it�s right! Do it for yourself! Think to yourself that you would do this even if you were the only person attending the rally. Think of Gandhi. Think of Martin Luther King.
You have been very frustrated for years with this broken immigration system, right? Perhaps you�ve been stuck for years, no raises, spouse cannot work, children aging out? How many times have you wanted to tell Congress what�s on your mind? This is likely your ONLY CHANCE to do so! Again, think of this in terms of you attending even if you were the only person attending. Attend because you are mad. Attend because you want to see change. Attend to make yourself visible, and make everyone out there know of your silent struggle. The silent struggle that you have had to put up for years. Even if that�s all you do, you will feel better. People will know the unfairness that you have been treated with! Attend because IT IS THE RIGHT THING TO DO! If your friends are not attending, try to convince them, but if they choose not to go, don�t let that influence you! Sometimes in life we have to do things just because they are right, no other reason. Will this rally work? Will lawmakers listen? Will my employer be mad that I took a day off? Will I have to spend $500 to get there? None of that matters! The only reason of why you should attend is because you have been abused, and you will not take it! You have dignity! You will go and tell Congress to stop messing with you unfairly. You have the power, freedom and OBLIGATION to do so! Your children will be proud of you. Remember that you have to be in the country to apply for I-485.

Is this true for Consular Processing applications as well ? I thought CPs are filed at the local US consulate (Mumbai in our case). Additionally, I have a question about I-485 - CP filing and retrogression. Once we file the 485, does the CP get stuck in case there is retrogression in a few months time or is it that once we have applied the process keeps going ? Thanks in advance for the information.

Think of something that is unique, gets media attention, something that has not been done, but conveys the message in a very subtle way and yet is very powerful and will create a lump in the throat.
Free math turoring, free SAT preperation classes, you get the idea....
Good idea, do something constructive and get media attention. This solves multiple purposes, media attention, best use of time, and would also convey a positive message.

i would like to move away from the focal issue of rally participation for a moment- only to broaden the question. yes i perfectly realize that there are many motivated members that had genuine compulsions of various kinds that did not allow them to consider being in DC. i could be one of them tomorrow. i also know that they are not the majority of non attendees. still, to again answer a previous question, 2,000 registrations was a pretty good number from a crowd that likes things handed out to them. my question though is related to other iv activities. going to a rally is a bigger decision, true. so how many of those who are espousing moralistic platitudes about "cheapening" and "not associating real people with userid's" or blaming chandu's words have participated in other actions? have you joined a state chapter? are you active in it? did you attend a meeting if you belong to an active chapter? if you have no chapter did you volunteer to start one? did you volunteer for pre rally activities? have you met your local lawmaker?
i could go on, but those are key questions. those who complain about trivia need to step up and show their own commitment. the way of this country is to petition government by lobbying your lawmakers. nothing cheap about that one. in fact it's an incredible experience, open and educational to say the least.
you and i do not participate in these things because "he said and she said', we do it for ourselves. please always remember that. set aside egos for a larger motive and see if it feels good....
for days i bumped the state chapters thread up with minimal response. here was an opportunity to meet others like you and plan these meetings together. what's the good reason for that apathy?

To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly and I apologize for that. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?

I guess this is a new H1B filing rather than a transfer from Employer #2 to Employer X. if this is a transfer, OP is in trouble as you suggested and the employment from transfer approval date till now will be considered "unauthorized work".

Unfortunately i doubt that anyone wud raise it in the senate. As it is the H1Bs are facing issues, can u imagine the uproar NumbersUSA wud create on hearing this. There are a LOT of things wrong with the US immigration system.

BTW I just asked another collegue in my office who is also an old IV member. He told me that you have a got a greencard recently. You were an IV member and you tried to hurt IV members by opposing the provision to file I485. You were scared that others with early PD will get to apply and your greencard will be delayed. I was stunned to find that we have such people posting on our forum and preaching others.

I expressed my opposition to a certain stance that IV took, which I believe is quite democratic. Your reason about me worrying about people with earlier PDs being able to file is false. I had a very old PD myself. I was opposed to opening up the flood gates to allowing everyone to file for EAD and AP which would jam the whole I485 system. I was of the view that we try fixing Name check and I485 as a priority.

I know nothing about the law, but as far as I know today the democrats are trying to pass a bill in which the people living illegaly for over 2 years can apply for temporary working visa that will let their spouses work (nothing wrong with that, just the exclusion of the H-4s as spouses of temporary workers which are the only ones not allowed to work). If they do not get 60 votes today, it passes tomorrow to a compromised bill that it says that if you came to US before Jan 1, 2001 you can apply for the work permit, and the green card later and then the citizenship. If you came between 2001 and 2003 you have to go back and get a work permit and come back, and if you came after 2004 no special treatment. since nobody has included in the ammended bills the H-4s it cannot be discussed tomorrow, but I do not know what is the procedure to get a bill considered and debated, there is a bill that considers the H-4s right to work and it is called TALENT "Through the Advancement of Legal and Educated New Talent.” but who knows if it will get considered.

The letter is a clear indication that Dept. of State and USCIS are not in sync. The concept of priority date apparently is only used by DOS and not the USCIS. God knows how PDs cutoff's are determined given this incoherency between USCIS and DOS.

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.

Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

I work for company A in india which has a subsidary company "B" in US.
On "B"'s request i worked in US for company B from July 2006 to Nov 2006 (for which i have valid pay checks).
I went back to India and worked for A till June and i came to US again to work for Company B.
Now as soon as i entered US, i have applied for a premium H1 company transfer to Company C.
Now i got a query to submit my Pay checks which i do not have as i resigned Company B after coming to US.
Please suggest me whats the ideal way to answer this query...
