If you are from India or from a country which fought for its freedom, you would not ask this question.
When M.K.Gandhi held his first rally against the British rulers(nothing personal here Franklin and Mark :) ), it did not result in immediate freedom, but was it worthless ?
It's not just India that won freedom either, don't forget USA!
Although I do admire Gandhi's approach more.

We do NOT support H1b increase without first reforming the EBsystem - we are neutral on this issue. There is nothing for us to gain by either supporting or opposing H1-b increase. We cannot support it because it worsens retrogression. We cannot oppose it for the simple reason that we are ourselves on H1-B. If someone thinks H1-B is bad, then how on earth can you justify giving GCs to these H1-Bs ? Why don't we start by deporting ourselves then ?
The reason zazona and numbers USA are "successful" is simply because they are citizens groups - and they have a sympathetic audience of folks who lost their jobs, as well as sympathetic mouthpieces like Lou FOULMOUTH. Politicians are bound to give weightage to these people's concerns (valid or not) if they wish to remain in power.
Lets leave H1-B bashing as an exercise to the zazona,foulmouth and co. We have scarce resources to begin with as it is, and they are best spent on something constuctive.Unfortunately, we do not seem to have any shortage of ideas on what new items IV should be working on.

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.
This is incorrect (highlighted in Blue above). Just because new H-1B petition is approved, old I-797 is not canceled. Again, gapala, understand this, if old I-797 is not canceled, beneficiary is authorized to work for old employer for I-797 validity dates. Unless, Employer request to cancel H-1B petition, employee can come back to work for that employer even after starting working for Employer B.

If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.
H1bslave, in your case your PD is Sep 5 EB2. I see something in the distant horizon. PD of 2007 and beyond or EB3-India I see no hope.
Atleast you can survive on a lifeboat called EAD and AC21.
Note that list of occupations changes constantly. I lived in Canada for 20 years after coming as PR on point system. It works well there, if you think money is not everything. Education is equally good. People, of course are far nicer and friendlier. Even border immigration and custom staff show a friendly face and attitude..

Even mine is EB2 with level II. I did not see a single case from my company with Level III or Level IV but still a lot of them are EB2.
My 140 approval says: Mem of Profession w/Adv Deg, or Exceptional ability Sec 203 (b) (2).
My understanding: this is EB2.

Hi - I have had a very bad experience with Fragomen, everything was filed correctly but the way they treat their client is pathetic. I have heard a lot of people are victims of this big corporation, lets get together to fix this.I had used their service once when i was in L2.They were the attorneys for my wife's corporation and my wifes corp files their visa extension only just before it expires.I was on L2EAD and the safer bet would have been to file atleast with the same petion extension for my ead extension.They charged about 1000 dollars,but i dont know how,i got my new EAD card and receipt notice together.But the L1 extension notices were received after about a week of receipt of ead.EAD was still far ahead of the processing time at vermont service center.
I still doubt filing thru attorneys makes things work out quicker.
My first EAD (used an attorney) in L2 was approved in about 65 days.Extension got approved in less than 20 days.Currently i am on L1 and my wife on l2.I applied online for her EAD and it is almost 80 days .No updates yet.

you are half right, the country quota laws were put much earlier than the off shoring companies, but remember that the retrogression only started in the last 10 years when those companies came in the picture and skewed the lines .. that's ur cause and effect!
I am in software and would be satisfied with resticting this rule to the software field, but feasibility wise, rules won't get micro-tailored this way.
I always tell myself i shouldn't go on with the discussion, but here i go again..

So what? Just because they came and skewed the lines doesn't mean you can choose where you're born or when. the rule is unfair wihtout any reason. there is no graceful solution short of removing the quotas. anyway I doubt fairness is the reason you're so fond of this quota.
Here's a one step way to quit.
1. Accept that the reason you're defending this useless rule is that it benefits you.

There has been some discussion about travel outside the US when one files for I-485. I found the official USCIS document (see the right hand side of page 4 on link below) that mentions that if you're on an "H" visa, which is the case for a lot of us, we can travel outside of the US without applying for advance parole.
