Organize it if it not organized. If you cannot do it for some reason, then take appointments on your own and go and meet them. While we are making efforts on the hill, it is important to have grassroots level efforts going on across the country

People rotting in I140 would indirectly helping to I-140 approved ones.Technically say for an example 40000 EB3-I are stuck in I-140.. they will simply be not considered in 485 queue so USCIS will not see them in "Demand Queue" and that also pushes USCIS to forward dates. Now I-140 stuck , though his date date is current can't do anything except getting frustration.

My current H1B was sponosred through an educational institution and was hence cap exempt. Will I be able to transfer my current H1B if I decide to move to a private company?

When I spoke to my Lawyer about the same issue he said that if the H1B visa was never counted against the quota, you can not unless the visa numbers are available in the fiscal year. He also mentioned that the move into for profit company would be considered as a new visa and should counted against the quota.

Nice Post hydboy!! Quick question though, Would you have put the same argument if you have not filed your EAD during july 2007? Guess not..Let us stop this..now.I agree with what you are saying,by the way.

Without strengthening AC21 if you allow everyone to file AOS then anti eb folks like Grassley, Sanders, Sessions, Durbin will move from targeting H1b to targeting EAD. It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.

I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..

Hello guys,
I had a strange issue with my wife previous H1-B.
she came to US on H4 on 05.03.
some x comapany processed her H1 and got approved on 10/1/2004
and valid till 9/30/2007.
on 1/2/2006 she change from x Company to y comapny and still working for y company.

any help with my queries is really appreciated.. :confused:
A very surprising thing happened in our company today. Shocking it may seem, they laid off 5 employees in my department today without any notice. Today's happenings makes me want to gather as much info as possible in case something unexpected might happen.
I am a July 2nd filer of 140/485 concurrently. No I140 approval yet. Received AP and EAD for both me and my wife.
If I request my employer not to revoke I140, will I be able to use my EAD for my next job?
Can someone give suggestions on what other options I have if something terrible happens to me?

Well, I hope mine gets resolved sooner than 6-8 months! My EAD is already expired and I could not apply since there was nothing in the application where I could show my status which is PR.
TravInd, you are right about people not knowing the priority dates and not aware the GC was a mistake. In fact, I still don't know for sure if mine was a mistake. I will know only when I find it out through the lawyer. My previous lawyer who worked on my GC case said congratulations and everything was fine. I am eager to find out if it was a mistake on my own.

I also participated in meeting the lawmakers...Sept 18th to be exact.:) And yeah, I've been very nicely coached by Sumita on what to say and what not to...;)
What I meant was meeting those reps who have not been contacted. And which can be done locally all over the country.
I hope I'm clearer now...:)

We just covered about 150 lawmakers thats just ~1/4 of the lawmakers. Everyone can do the lawmaker meets at their local office, it doesn't require lot of effort just a few phone calls and few hrs to spare. Atleast one person from U'r state chapter would have attended the lawmaker meeting, U should contact U'r state lead on this and proceed further. Also those people who already attended the lawmaker meets are coached on what (not) to say during such meets..
I am sorry to say that "undocumented ppl" have more sponsors in Washington than that for EB-based immigration ppl:D We can sit and whine on forum, unless we take our issues to the forefront (lawmakers and media) no one is going to bother us:p Thats reality:D

Yeah there are tons of people who got their GCs with PD 03, but there are tons more waiting in 02 to get their GCs.
Sure there may still be 2002 files waiting but it is definately not a GREAT number. Here are three logical bullets to conslude that.
- Many people with 2000/1/2 dates have already left USA - Tired: Could not
take the delay:Found good oppertunity back home or elsewhere
- Black labor market played a part to shift a considerable load either to EB2 or
PD date from 1999/2000 and thus many people preferred that path either
stuck in EB2 or have already got their GC
The only thing we can be unsure about stuck in NC with those early PDs.
Having said this, it is ofcourse impossible to predict perfect chain of future flow, I see hope for EB3-I in this year, particularly last quarter at least for the people having 2004-Mid and before PDs.

There were simply two barriers put by CIS for EB GC one is EB Category (horizontal bar) and Country of birth (vertical bar) Now country of birth is something not in your hands where as EB category is something that you can change (acheive) its in your hands. Come one all of us if we study hard can qualify for EB1 but because of various reasons or circumstances we chose to be in EB2 or EB3 (people who crib about employers or any other reason know in their hearts that i they wanted to change they could have simply they decided to remain happy in what they got)
So instead of asking to mountain to come to mohammed people should take this news positively and see how they can benefit from it. The spill going to Eb3 ROW was not helping any one since there is no way one can change country of birth

Apart from Deniel notice I also got LUD on I 140.
Could it be related to old employer revoking I 140?
Since I have transfered after 180 and did Ac 21 - am I covered.

I came in 2005 and was eligible in 2006 for EB3 as per company's policy. There was huge retrogression then and I was hoping EB2 would be better for GC and career. Anyway, that's not the point.
One thing I like is that people are acknowledging the porting is a loophole and plan to use it anyway since it suits them.

If everyone were to go with your logic, then I guess EB2 qualified guys must wait for .. well how many years, u tell us.. to apply in .. EB1 ".. And what shoudl EB3 guys do..
The point is, lets focus our energies on the main problem which all of us face, and not show any disgust on any one category. I know how it feels if someone is coming in front of me in my line.. But how can we stop them.
Lets bring attention to releasing those wasted visas, quota problems etc..
If equal spillover happens from EB1 to rest of categories, EB2 will affected immediatley.

With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.
I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.
I know CA promotes both , but issue is whether they do that equally.

In many consulting companies when a H1b person joins then first question he asks is Can I file in EB2 because I have Master degree. Then only they are creating a job requirement. So there is more possiblity of creating job requirement mainly in consulting. It may not be a illegal so no violation of law involved but it is not good faith. So we cannot complain to officials. Also I am not telling all the Eb2s are like that.
Are u saying all eb2s have earned the experience under the table. Then why couldn't you do so then ?
Dont blame the lawyers or the employers. May be there are one or two, which I am yet to find. But if you have seen it and very sure of it, why didnt u complain about it earlier to the appropiate officials.

Dont blame the lawyers or the employers. May be there are one or two, which I am yet to find. But if you have seen it and very sure of it, why didnt u complain about it earlier to the appropiate officials.
