[QUOTE=eb3_nepa]Guys pls lets keep these contorversial discussions out of here. Yes it is a valid point that H4s shud be allowed to work. However we cannot compare the US immigration system to the Australian one. They are 2 very different systems and the Blunt truth is, if you like the Australian system better go there :)
For openers, let me be totally honest. I am a IT worker who has been and seen others laid off due to the ability of employers to raise the specifications as to what was required for an IT job to the point that foreign workers with PhD's could be hired for less and US workers laid off, so I have a bit of a bias involved here with H-1b visas and L-1 visas.
That said, I would also like to second the statement quoted above and slightly expand it. Here in Texas, there is a statement usually made as one sits down to a table to play cards, "House rules." That means that, by sitting down at the table, you are implicitly agreeing to abide by the rules as established by that particular house. By obtaining a visa from the US government, you have _explicitly_ agreed to abide by the rules set by the US government. To claim that they are somehow "unfair" or "discriminatory", especially after you have agreed to them, implies, IMHO, that you had no intention of abiding by them when you accepted the visa.
During my career, I have investigated opportunities to work in a few other countries and have consistently found that they had significant barriers to a US citizen coming into the country to "take jobs from their citizens". While I might have enjoyed working, for instance, in the UK or Australia, I also accepted that their governments had the right to set their own "house rules". I guess, though, it may be too much to ask to expect similar consideration for the US government's right to set _its_ own "house rules," no matter how quirky they may seem to others.
As for the comparison of which visa holders' spouses/dependents can or cannot work here, I would ask the unasked question, "Why not allign these variances in the visas in the OTHER direction?" (I.e., why not simply change things so that NO spouse or dependent who obtained their visa based upon a primary visa holder is permitted a work-visa?) I realize this is probably not a popular position in this forum but, if for no other reason than being the "Devil's Advocate", perhaps it should be raised and considered. :)

Dont be surprised at the next VB or theone for October where EB2 india moves back to Apr 2004 ....DOS can always surprise you, as we have learned repeatedly, all calculations/bets are off when it comes to DOS.
That's Why I don't trust USCIS/DOS. We better work on legislative changes, that's the hope to fix this mess

Are you asking tha the information we provide be broken down into the categories listed above, or may we group all EB-2 categories and ass EB-3 categories together?
Did her original letter actually say ass EB3??? Or did you make a typo?

Hi all,
This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists. Is healthcare comparable to USA .
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue. But looks like in Canada they value your educations and other qualifications. Can IT professionals (non-managers) apply for Canada PR without a job or canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?
Please share your thoughts .
Thankyou
yes these are very relevant qs.....will someone from canada pls advice abt these especially the cost of living, property and savings....

Exactly correct -..
Back to the numbers game - .... The country quotas could disappear, and the overal limit could be increased, but without reforming the actual processing side the speed of approval will not change.
I was hoping for such a long time for somebody to realize this.
thanks Franklin

These idiots forget that passengers are paying the airport landing fees and refuleing charges etc. Those who forget customers end up loosing business. We flew by Emirates last tlme directly to Dubai. It was excellent, took less time compared to landing in Europe.

Hi,
I am from Jordan and I attended the rally. 4 of my friends "who are Jordanian and have their citizenships already" drove from Chicago to attend the rally, but they got lost in Baltimore. They wish all of us all the luck and they support all of us 100%:)
That have been said and as I mentioned on another threat, I know 10 people from India who work with me and promised to meet me there, but no one of them attended, and I called them before the rally at their offices and all of them were there. I am very disappointed of them.

The more I think about free MATH tutoring the more it makes sense. It conveys what we are really good at, "MATH", "Sciences", which unfortunately a lot of people lack here in this country. Gets the SKIL bill agenda in focus.

You dont deserve a red dot. Thanks for explaining the need for action in a passionate way. I know it does not matter, but gave a green dot anyways.

I had FREE company attorney but decided to file 485 etc. myself & it was so much better. You can easily do 140-485 etc yourself. Call me & I will tell you.
If at all use an attorney for PERM. In my situation, even that was screwed up & I had to do that myself.
It is high time, all of us capable of handling complex viral equations, do this simple job , spread the knowledge , save $$$ & contribute some savings to IV
Best wishes

Lawsuit will not help you. See AILA lawsuit for Visa Bulletin. USCIS did not even negotiate with AILA and chose to negotitate with IV. So you need to learn from it.
AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.
By the way, your Indian lawyer I dont know the name, sued DOL once and lost.
Secondly, how are you going to pay for the lawsuit? People here dont even want to pay $20 and you will need 20K or more for a lawsuit. Do you think you can raise that much?
Thirdly you are using IV site for your agenda. Instead of supporting IV you are creating your own selfish agenda and not listening to IV. I have seen lot of offensive messages by you guys. You guys celebrated when all of us got screwed
I do not support your agenda.
Although, some people may call it SELFISH AGENDA and advice not to use IV platform, I strongly support the cause. Some people may advice that once the labor is cleared, people with 2001/2002/2003... PDs will be at the front of the line. But, when those old labors are cleared, will they be able to apply for I485? DOL may say that by September 30 the backlog will be cleared. Is there any gurantee? Even all are cleared, they will not be able to apply for 485 now (has to apply by August 17). I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota.
Regarding IV platform, it is an organization for the GC sufferers and by the GC sufferers. So this is of course the right place. If IV is busy with other issues, then people have to start their own fighting.
I am neither sure about the legal complications nor have any idea about the legal fees (or who will pay it) etc. Better consult attorneys about the viability of the case.
BTW, my labor is not in BEC and I have already contributed $500 to IV.

stucklabor,
I hope you are right and I am wrong. So, "special handling"
cases do not go through labor certification at all. Do professors have to go through "special handling" labor certification?
If you are right then it means that an advanced degree holder in STEM from a US school with 3 years of prior US experience will be able to apply for I-140 and I-485 right away.
Thanks for clarifying.
Your interpretation is incorrect. An advanced degree holder from the US will not need labor certification. Please go through my and Appu's reasoning in earlier posts on this thread to understand why.
Per Frist's bill, an advanced degree holder in STEM with 3 years experience will be subject to special handling in labor cert. Your (iii) refers to this person. This person is not subject to the numerical quota.
An advanced STEM degree holder from the US does not need labor cert. This is because notwithstanding the applicant's admissiblity for permanent residence, the applicant can file for adjustment of status as long as he has an immigrant petition. "Applicant's admissibility for permanent residency" refers to labor cert for EB 2/3 workers - see section 212 of INA. So irrespective of labor cert, the advanced STEM degree holder from the US can file for Adjustment of Status and I140. However, this person is subject to numerical quota and has to wait for a green card number for 485 approval.
Put both the above paragraphs together - the advanced STEM degree holder from the US with 3 years experience has the best of both worlds - no labor cert, no quota, can file for I140 and I48.

I am one of the several may be thousand who have been affected. I am not using this for my slefish purposes. I am trying to get the suppoprt of IV and its members for this cause. I am not disagreeing with IV in any way.
This is an agenda for a common cause for all affected people and I want everyone to support.
Someone has to sow the seed and start the process. Doesn't mean since I started the thread it is my selfish agenda. It is part of IV's goal to get justice for all people who are affected by any immigration issue. So IV is the right forum to raise this issue.
1000 people * $20 each = $20 K. So that is not an impossibility.
If you have the will you have the way.

Sometimes it does not depend on you, I am in Backlog due to my company's lawyer does not want to file for PERM  . Anyway I am changing jobs and starting again but this time with PERM. :D
I understand your pain ( in fact i also could have been like you with BACKLOG LC clearing in SEP 30th ) .... Company dont want to file PERM because they can get you trapped for longer time !
My company didn't do a EB2 filing for me secretively so that i remain chained
with them longer - But now everything is current....
Lets hope your LC comes by the time PD remains Current.

This is my first post in this forum, only because I am seeing this Fragomen thread. I had a very bad experience, while working with a 'so called "reputed" India's largest software company' . Fragomen handled my L1 extension for this company, there was an RFE on a simple matter, but they took the whole time provided in RFE deadline to respond to the RFE. Finally when they responded, they responded to USCIS with the supporting documentation of some other employee. USCIS immediately denied my L1 extension petition, and I had to pack up and leave the country in a gap of 1 week. This Fragomen lawyers or paralegals have no concern or not even rendered an apology on this fiasco.
