I had emailed CIS Ombudsman's requesting temporary relief in such uncertain times...by allowing ppl to file for AOS..even if their PD is not current.
They replied to me ..but i think a more co-ordinated and deluge of such requests will make them take this issue seriously.
I think desi3933 is right -- that one cannot file AOS without PD being current. However, this does not mean we should give up pursuing our goal. The secretary of DHS specially made it clear that she is willing to push for changes both regulatory AND legislative. But before putting in any effort, she will need to know what changes to push for. She even specifically mentioned the issue with pre-application of AOS, which seems to me a real good chance to get the message delivered.
Just for starters, here are the benefits I can think of about pre-filing of AOS:
- By having all applications on file, let USCIS better predict case load and allow DOS Visa Office to make informed decision on Cutoff Date movements
- Create more revenue for USICS (DHS) via AP and EAD applications
- Reduce the work load of Overseas Consulates when applicants with AP does not have to apply re-entry H1B visa.
- Many H1B visa holders have to go through the administrative procedure when applying re-entry visa. This process is more or less a duplicate with the background check required for green card application. When the applicant is allowed to travel with AP, the effort of background check is consolidated and allow resources to be better utilized.
- EAD allows applicants more freedom to change job, this will results in better resource distribution to accommodate the rapid changes of the economy, and it makes the market the most important factor to determine wages.
Please add whatever you feel missing to the points and maybe we'll come up with a formal letter to communicate to the secretary.
Last, to address the concern that USCIS may be flooded by AOS applications from freshly off-the-boat H1B's, restrictions need to be put on the qualification of AOS. What I could think of is:
- Must have approved I-140 (immigration visa. I think this restriction makes the most sense)

Either u r heavily drunk or u r arguing for the heck of it. Whoz paying for whose free lunch? What proof can u or any of the core IVs show bout July 2nd reversed bulletin? There r hundreds of thousands of ppl who believe that AILA's planned lawsuit was the cause for USCIS' reversal. Agreed! IV's flower campaign made news but action? I doubt it. IV core needs to be transparent and needs to enlighten us with what IV did so as to make USCIS reverse the bulletin if they claim to have done something. If ppl were convinced of IV's actions, there wud have been a flurry of donations so far.

Go_guy when did you come to US, When did you go to Canada (Toronto).Which job are you doing now in Toronto?
I first came in 1999 Fall as MS student. Then in between, I went back to India during the 2002 downturn and then came back in 2005. I did my MBA finance at U of T and now
working as Analyst since my second year ( due to F1 visa restrictions I couldn't have
done that in US). After graduation I am working there but looking for better options as well.
I came as PR in Canada. But i look at the international students from India in U of T. They are far better of than the international students in US. Here they get 3 years work permit
after graduation and can also work part time while studying. With new rules u get PR quickly after 1st year. Also during the 3 year post degree now they are eligible for the government health care like PR/Citizens. Canadian immigration is now highly tailored toward people
studying/working in Canada.
Compared to that, US treats its international students like dogs. If I get the opportunity to relive, one thing that I would not have taken was doing my previous MS in US. Moving to Canada was the smartest decision taken...no regrets.

Get support from whom? The same corporations that want to outsource jobs to low cost countries AND also lobby for H1B increase, again to keep wages low and all this to increase their bottom line. We need to re think our strategy and get it straight as to who is on our side and who is not.

First decide whether we are FOR CIR or NOT.
Looks like a lot of people have doubt on this basic question.
The answer is not simple because of the various stages many people are in.
In fact for me CIR in its current state is better. However, for a person who has not cleared the labor, cir will not be favorable, as he/she has to reapply.
In my humble opinion we should just ask for one or two minor things, and this "comprehensive" approach of we are the "pork" in the bill is flawed.
We should at the most ask for the basics. "recapture of past visas", and ability to file I-485 immediately. Highlight that this is only a matter of interpretation by uscis and no major law change. These two points itself will have IMMENSE benefit for us.
Any change that is drastic like removal of visa cap for STEM etc, most likely will forever remain a dream.
I can tell your case. If you apply now by EB you will get gc within 3 to 7 years time. If you apply by point system after 5 years of USA experience and you will have employer sponsor you will have 16 points more than those who are coming fresh to USA. So both point system and EB system you will get at the same time period. Process delay will be minimal as no labor or I140.

My GC filing company is not a non profit institution still my labor took 2 months and I 140 took less than 3 months.

It is not not primarily based on salary only, I believe, it has more to do with the nature of your job, job title, size of the company, type of company, for profit or non-profit.
My wife is a University professor, applied for our GC, EB2 India PD date august2007. We got our labor approved in a less that 2 months, we got our I40 cleared in 5 months, ( applied in January 08 got approved in June).
I believe , we are able to move so fast in this process was mainly because the type of company she works for, in this case the non profit institution.
Now at this point in time, I would like to ask all the gurus, are the dates going to move fast in next few months?

I just called and was asked for names and comments. I told her my personal experience: came 10 years ago, worked 5 years, approved I-140 2 years ago, stuck in the queue, working as a scientist at Stanford University, and can not apply fund and have difficulty attending international conference. She asked the state I am from. I strongly urge TX members to call. It is very easy.

If you have all the required documents file 485 your self.its no big deal..
offcourse if u r starting from LC and 140, well you have to live with it..there is nothing like a good attorney, really..unless you are the only client the have
