Hello,
I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

Most of the members here think. GC are long pending only because of beneficiary or USCIS only.

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.
Any input is appreciated. Thanks in advance guys.

If i have labor and 140 approved with previous employer, can i go back to join them on H1B and continue GC process? Appreciate any advise. The new company is unable to start GC process due to economic conditions and capout date is Sept 2010.

The present h1 position comes under university (non-profit) category. You cannot transfer your H1 to a company which falls under profitable category. You need to apply for a new H1 which falls under cap.

How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.
While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.
This will help few of our folks and your thoughts are always appreciated.

Yes you can call them as many times as you want. If the case is serious you can request the Level 1 employees to escalate you to Level 2 and most of the times they will oblige.

If the investment property was under passive investments like absolute NNN lease or TIC investments, then I am guessing it should be alright. Check with an attorney first.

Folks, I'm in the current sitation. In 6th year of H1B, aplied for PERM labor pending with ATL processing center for >15 mtonhs. Attorneys are filing for 7th year extension. I need to traval in the next 2 weeks but not confident enough to get everything right, I need my visa stamped aswell, which with the current H1B validity, would be onlyuntil 22nd Oct 2009. I did try to convince my Managers that they file the extension under premium processing and I could get extended visa until Oct 2010, but Attorney advised that it is not necessary and I should be fine to go, get my visa stamped and come back.
2 points I'm concerned about are,
1. Since I have < 6 months validty on current H1B is it safe to travel and I would hopefully have my extsntion reciept number when I go for stamping.
2. Heard lot about denial of entry at POE, I'm trying to avoid certain airports that I has problems (JFK, EWR etc). Not sure I'm doing enough to be safe.
Any advise is greatly appreciated.

I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

I had my LC I140 approved, but due to retrogression I cannot continue with the adjustment of status.
This is my question:
If I move to a new position that would require me to file new LC (PERM), am I still subjected to the 365 days rule?
I am confused because my employer filed the LC 365 days prior to my H1B expire on the 6th year in order to get the extension. Now, since I can only have one year extension and I have less than 1 year left on my H1B visa, can the new LC still be filed? Will this jeopardize future H1B extension?
Am I missing something here? Is there another strategy?

My husband I-140 receipt notice has a wrong receipt date, instead of june 20 it has july 20 receipt date, the rest of the forms like I-485,Ap has the right receipt date, since he filed for labor substitution receipt date is critical since the deadline was july 16, what should we do anyone has the same situation pls help:confused:

No issues, since her H1B is independent of your I-485. As long as she was in her old job/the job mentioned on her G-325 on the day you filed your app. you should be okay.
