I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

My wife was on same boat as many students. Her H-1B petition had an rfe. RFE was later denied and we still have MTR. This year she got her H-1B approved without RFE. We did specify in application about previous year rejection.
Bottom line is there are no easy trends to observe. Luck seems to play a big role than anything else. Obviously, all the documents must be in good shape.

Hello.
I will be needing a new re-entry permit(i-131) while renewing my green card and i was wondering if it was possible.
I am going to study back in my home country for 4yrs.
first 2yrs(2010-2012), i am going back with reentry permit.
after 2yrs(2012), i am going back to USA for 6months to renew my green card(going to expire in 2012) and reapply for a new reentry permit.
If i wont have time to get my new green card, i am possibly thinking of going back to my home country for 5 months and going back to USA for 2 wks (to retain green card status) and again, going back to my homecountry for 3 months.
Would going back and forth to my homecountry and USA will affect me from losing my green card?
Any advise will be helpful. Thank you!

Is core working to get similar bills for HR.5882 and HR 5921 to get introduced in Senate?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

In 2007 , I joined a new company and filed my Labour substitution+I140 petition in June 2007. This got approved in November 2007. but my H1B transfer to this company is still not approved. Earlier this year (2008) I went back to my previous company whose H1B is still valid and waited for my old H1B to get approved with no luck.
Now, i wish to start my GC process with this new company, can I retain my old priority date of I140 ? There is absolutely no chance that I will get I-140 approval copy from my old employer, but I have the receipt Number and I know the PD.
Any help is appreciated.

My wife filed I-539 for changing status from H-4 to F-1 at end of May. We have the receipt and the case is now pending. Is it possible for her to request cancellation of this change of status and continue in H-4 status? If so, does anyone know how to ask USCIS for this?
