Hi I'm a Moroccan citizen I was placed in removal proceedings (NY Buffalo) and took voluntary departure. once my wife's divorce was finalized we got married while on voluntary departure. we filed motion to reopen the case and it was reopened and transferred to Los Angeles, CA then the judge closed my case based on marriage with an I130 receipt without prejudice. The I130 was filed on june 2009 and was transferred to Los Angeles on November 12, 2009. I made an appointment with Info Pass but they just said you have to wait untill we call you. My lawyer said I can't file for the I485 untill the I130 is approved. My question is: How long will it take before we will be called for an interview?

Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

For years, open-government groups have fought to make the reports public, and for years, many lawmakers have kept them under wraps. Or so they thought.
By insisting on secrecy, Congress instead created a bootleg market for the research. Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. I have a similar question. My EB-3 PD is August 2005 (I-140 was approved but I never filed the I-485 because of retrogression). Few months back I found out that the employer had withdrawn/revoked the I-140. Now my employer is getting ready to file my EB-2 I-140 and my question is: Can we retain/interfile the priority date from 2005? I know the answer is yes but I am looking for examples where any fellow member was able to successfully do so. Thanks!

Regarding the receipt notice of I-485: which is the difference between the receipt date, receipt number and receipt notice.....from my understanding....the receipt date is when your I-485 application hits Uscis and the receipt notice is when the Uscis is really opening your package and looking at it?
Is it safe to travel( with valid H1b) knowing that your file hits the Uscis...or you have to wait for the receipt notice( now with so many filers for July, is it true that Uscis will send the receipt notice very late, maybe months, I mean later than the June filers.)?
Is it safe to travel after you file for I-485 and before getting the receipt notice....hoping that the receipt will come after you returned to U.S?

I have a question about filling out this section: PART 4, Processing Information. I am the employer and applying for a current H-1B holder (currently with another company) to transfer to my company AND extend his stay. He is currently here in the US.
Some people tell me I don't have to fill this section in, however the instructions say "if beneficiary...is outside the usa OR a requested extension of stay...cannot be granted, state US consulate or inspection facility you want notified".
What address should I put/consulate should I use (H-1B holder is from India).
Questions: 1) do i have to fill in all 1.a,b, c, and d?
2) does it matter if i check off consulate, pre-flight inspection, or port of entry?
3) if beneficiary doesn't have a fixed address in India anymore can I leave it blank?
Thank you for any help.

Is it possible? Pro-active Finger-Printing without appointment letter.
I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon.She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.
Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.

The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.

I am stuck out side of US for my name check for last 9 months. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.

I applied AP around same time and got it couple of days ago.
Check not cashed is indication of missing mail, either by mailing services (USPS, FEDEX, ...) or in USCIS. Average time for check to be cashed is less than 10 days.
Whether you should open SR or re-apply, someone who faced similar situation can provide better answer.

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?
