My manager got an email from USCIS saying my I140 is approved and they will mail the approval notice. Online case status show that approval notice emailed. But we haven't received any emails about the approval notice. Do USCIS sent paper approval notices??

My company has been going through layoffs for the past 3 quarters and are unable to start my GC process. I believe they have to wait for 6 months before they go forward and apply. I am talking about a big company with different departments like operations, marketing and most of the layoffs are happening in these, but recruitment is active in IT. They are regularly recruiting new resources and increasing the head count.
I have following questions:
1) Can my company show that the layoffs are happening in different depts and go ahead and process my GC?
2) What is the risk in doing so.
3) Anyone experiencing a similar situation and could successfully get their GC process started and have approved labor/I140?

Hi,
My I-140 finally got approved last week. I'm a concurrent July 2nd 2007 filer. My I-140 was initially denied and was approved on appeal. The process took some time and created a new problem for me.
I looked at the USCIS website and they're currently working on cases filed on July 16. It seems my case (485) came and was passed on as my I-140 was pending at the time.
What can I do now?

I don't mind the noise overall but this camera is very noisy in the shadows...i shoot a picture in the sunlight and then print it...picture quality is awesome but in the shadows...man so much noise...
maybe the d2x will solve the day?...lol

I guess that should be OK. Only H1B rules require one to be continuously earning. On EAD, if you have a potential employer who is willing to hire you after your GC is approved, you can remain without regular paychecks.
I know of the guys, who actually availed unemployment benefits on EAD, and yet got their GCs. At least sitting without regular paychecks is better than that.

could any body please let me know which time is the best time for checking/taking interview appointment from VFS site as from 3 to 4 days onwards i am checking for the availabity dstes in VFS site for scheduling appointment but there is no dates available for our language.
I read somewhere regarding the partiicular time(as soon as after updating the available dates in that site) , at that time if we check the VFS site if any appointments are available for that day it will show else no dates in that full day. thank you for all .

My wife's H1B got approved earlier this week through company A. Company B also made an offer last month but they are still working on the H1B visa issue with the attorney.
So, my question is if this company (B) files H1B now, then it should be a "transfer (not subject to quota)" or "new petition (subject to quota)"?
I think she is already on H1B as of today with COS effective immediately approval so any new employer can only apply for transfer and they don't need to ask for COS. We will not have pay-stubs to transfer as we are still to receive the I-797 copy and apply for SSN so that payroll can be run for her.
Please let me know if anybody has got any insight on this situation. Very much appreciate your time.

I have a new job offer from one of the largest product based company's Global Consulting Professional services.
Situation:
1. I am in a PORTABLE AC21 situation over 180 days of 485 filing and an approved I-140.
2. I have requested the company to prefer my EAD over their H1B offering.
Questions:
1. If I take their H1B offer, what are the risks of USCIS asking me a client letter before joining? Please note it is a huge org. The company intends to take me in after obtaining LIN# from premium H1B processing.
2. The prevailing wage on my LC when filed in 2005 was $60,757 and the offered wage at that time from my company was $76545. My NEW offer in 2010 stands at $118000. Is that an issue?
3. If I use my EAD which is expiring September2010 and due renewal can I keep continuing work until obtaining new EAD?

Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT

Hi,
I got H1-B petition (I-797) approved in 2008 but due to recession, I couldn't appear to consulate office. I did not get a chance to work in US for that employer so I don't have any pay stubs for that employer.
The petition is approved till 2011. And now I am planing to either appear for visa stamping or transfering I-797 to any other sponser.
My queries are -
A-Appearing for Visa stamping now after long time is right option or is there any chance of rejection?
B-Since My current employer is not able to employ me there,I want to transfer my I-797. Can It be possible? How much risk is there? If it can be done that what is the process of that please?
C-Since petition is valid till 2011, If I get stamped this year Oct / 2010 what will be duration of visa?
D-Any sponsrs list ?
