    I've got some questions/comment to understand your situation

    1. How do you know it is stuck in security check? What is your attorney's suggestion

    For regular EB applications you can apply for 485 when priority date is current

    2. EAD is generally adjudicated within 90 days

    3. She should have a visa of her own - if she cannot be your dependant

    My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

    I am currently doing my MBA here on a H4 visa. I want to know if I would be eligible to apply for the H1 Visa ( in the 20,000 quota) without converting to
    F1 status. Please advise.

    The post office cannot forward your card. If there is a name
    other than yours on the mailbox you use to get your mail,
    the post office will not deliver your card. In either of these situations,
    they will return your card to us as undeliverable.
    - If you move before you get your card, notify your post
    office, but also call our customer service number to update
    your address and emphasize when calling that you are waiting
    for your card.
    - If you are living with someone else, and that person’s
    name is on the mailbox, we recommend you add your name
    to the mailbox, or you run the risk the post office will return
    your card to us as undeliverable

    Something I found on USCIS site. Not sure if it applied to just the greencard or the EAD card as well. But this is a good tip.

    If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?

    My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

    Hi All

    My wife changed her status from F2 to F1 and recently she went to India, so she had her visa stamping appointment on Feb 18. at the counter the visa officer told her that she hasnt paid the SEVIS fee so has to go outside and pay online and come back with the receipt. she did and went back and she was told that she has got the visa and the passport will be mailed to her. she hasnt received it yet (its about 8 working days now), and when i contacted the consulate they replied: "We have provided a pink sheet, which says that the SEVIS is not updated in the system. Once it gets updated the passport will be sent to the mailing address."

    1. is this delay a normal occurance and how long it takes in such case?

    2. do you guys see any problem in this case?

    I am on H1 visa and I have a sister with citizenship.
    I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
    Is it OK to file 2 green cards applications? which one will take place then?

    Approaching a senator is always okay. You don't have to prove that you are a taxpayer to get a senator's help. It may or may not help but it definitely is still worth a try. Note that if the senator provides some help and the wife and child visits for graduation day the visa status applications should most probably be for B1's (visitors).

    Folks,
    I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).

    The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.

    Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?

    Hi,
    I am student on OPT extn working for an Non Profit Organisation ( non everified) , Since 2 months, I Know i should not work for non everfied company on OPT Extension, So i asked my company to do H1 asap, since workiing for non everified aslso considered as unemployed, But i am aware that in entire OPT we can unemployed for total 120 days.

    My company is an Non Profit Organisation & dont have relatioship with any educational institues or research org.

    Is my company eligible for H1 cap exempt, so that i can keep my start date as approval of H1? so i wont fall out of status since my H1 starts as the days of approval............or I need to wait until oct 1, 2010,

    Even if i start at oct 1,2010, Will it affect my green card processing, since I worked for non everified around 6 months...........

    Please provide your inputs.......

    Hi,
    Right now NSC shows that the processing dates are "August 10, 2007". What does this mean? Does it mean that

    a)All apps with notice dates before Aug 10, 2007 are processed?
    b)All apps with receipt dates before Aug 10, 2007 are processed?
    c)All apps with notice dates after Aug 10, 2007 are being processed?
    d)All apps with receipt dates after Aug 10, 2007 are being processed?

    My 485 application has a receipt date of July 19, 2007 and notice date of Sept 18, 2007. Any insight into the dates???
